When Erma Lee, Compliance Director, for JPS Hospital brought the audit report of improper usage of Modifiers 59, 25, and XU to the attention of management, she expected a change in practice and close monitoring of the billing errors. Not only was the action plan rejected and CMS not paid back, but the hospital fired her.
